Cookies by Design Defends its Smiling Cookies
PLANO, Texas, Jan. 6 /PRNewswire/ -- Crumb Corps, LLC, owner of the Cookies by Design concept, announced that it denies the allegations lodged against them by Eat'n Park, a Pennsylvania based restaurant chain that claims Cookies by Design has infringed on its trademark for a smiley face cookie. In a lawsuit filed in federal court in Pennsylvania, Eat'n Park asks that Cookies by Design be restrained from selling cookies with a smiling face design or any confusingly similar mark. Cookies by Design denies the allegations in the lawsuit and will mount a vigorous defense of this matter.

Cookies by Design has been producing cookies with smiling faces since it was founded in 1983 by Gwen Willhite. Since 1983, Cookies by Design has had extensive advertising of its cookies with smiling faces. Although Eat'n Park claims that it first used its smiley face mark in 1985, it did not contact Cookies by Design with its concerns until 2009.
