CHICAGO, July 18, 2016 /PRNewswire/ -- Moll Law Group filed its first lawsuit on behalf of Barbara Ross, a Chicago woman who was diagnosed with ovarian cancer in 2014 when she was just 39 years old following her use of Johnson & Johnson Baby Powder and Shower to Shower. The complaint was filed in the United States District Court for the Northern District of Illinois alleging that the Defendants knew or should have known about the hazards associated with the use of its products and negligently failed to warn consumers.
The complaint alleges that the Plaintiff's daily use of talc-based powder for feminine hygiene purposes caused her to develop potentially fatal injuries, including ovarian cancer. The complaint further alleges that during Plaintiff's use of Defendant's products, Johnson & Johnson engaged in deceptive and fraudulent marketing despite their knowledge of scientific research that talc may increase the risk for developing ovarian cancer.
Barbara Ross used Johnson & Johnson's Baby Powder and Shower to Shower as part of her daily routine from 1992 through 2014 for hygienic purposes. Following her 2014 Ovarian Cancer diagnosis, Barbara Ross was required to undergo removal surgery for both of her ovaries and fallopian tubes at the young age of 39.
Since 1971, numerous studies have shown an association between talc and ovarian and uterine cancer, yet Johnson & Johnson has never placed warnings on its products to alert its consumers of the dangers of its use.
According to the complaint, Plaintiff seeks compensatory and punitive damages against Defendants and a Jury Trial.
Recently, on July 15, 2016, a motion of consolidation and transfer was filed before the United States Judicial Panel on Multi District Litigation. Based on the numerous complaints filed against Johnson & Johnson for its talc-based products, this motion seeks to consolidate these cases to promote efficiency by deciding issues of law and fact that are common to all plaintiffs.
Moll Law Group has been contacted by a large number of talc-based product users around the country and is currently preparing to file additional lawsuits for claims of ovarian cancer.
