Changing Social Security Disability Rules with Regard to Addiction
MALIBU, Calif., March 18, 2013 /PRNewswire/ -- The Social Security Ruling (SSR) 13-2p, which becomes effective on March 22, 2013, provides new explanations "concerning how it considers whether 'drug addiction and alcoholism' (DAA) is material to its determination of disability in disability claims and continuing disability reviews." This ruling replaces several previous rulings on the matter. The question for those who determine disability benefits is whether or not a disability would exist in the absence of an individual's drug or alcohol addiction.
"The questions posed by the Social Security arbiters are good ones to ask," says Richard Taite, CEO of the Cliffside Malibu addiction treatment center. "In many cases, permanent disability is zero once you alleviate the alcoholism and addiction. Even in more complex cases with challenging co-occurring disorders, I have yet to see an instance wherein alleviating the issue of addiction did not greatly diminish one's permanent disability, and in some cases, no permanent disability exists."
