NEW ORLEANS, Feb. 9, 2015 /PRNewswire/ -- Mark Clark, a litigation partner in Burleson's New Orleans location, will present a webinar on February 11 titled Hot Topics in Oil and Gas Indemnity, Defense, and Insurance Provisions. The session is being hosted by Electric Utility Consultants, Inc. (EUCI) and will be held from 1:00 to 2:30 p.m. Eastern time.
The event is designed for in-house counsel, energy lawyers, insurance professionals, investment bankers, and commercial professionals involved in oil and gas contract negotiations. It will cover a range of topics, including:
- The maritime contract test recently developed by the Fifth Circuit for work on the Outer Continental Shelf
- The six factors for determining when a contract is controlled by maritime law as set forth by Davis & Sons v. Gulf Oil Corp.
- Application of the Louisiana and Texas anti-indemnity acts on offshore operations
- Judicial and statutory expectations in the application of anti-indemnity statutes
- Conflicts between indemnity and insurance provisions
- Insurance coverages that protect a party's obligation to defend another
- Gaps in coverage related to indemnity claims
"Defense and indemnity provisions are found in almost every Master Service Agreement related to the performance of oilfield services, but the anti-indemnity statutes of Louisiana and Texas may render such agreements unenforceable," said Clark. "This seminar will put the knowledge attendees need to avoid litigation risks right at their fingertips by delivering a broad understanding of anti-indemnity statutes, maritime contracts, and potential insurance coverage issues."
Clark, whose legal career spans more than two decades, focuses his practice on civil defense litigation and arbitration. He is licensed in four Gulf Coast states and represents clients in a broad range of matters, including self-insured tort, product, maritime, environmental, personal injury, insurance coverage, and breach of contract claims. He also has deep experience in a variety of energy exploration and development disputes in offshore and onshore environments.
In addition to his background in state and federal litigation, Clark is seasoned in arbitrating domestic and international disputes related to construction, maritime contract claims, and insurance coverage issues. He has examined hundreds of insurance policies and is well versed in all forms of general liability, property, energy, pollution, all-risk, excess, bumbershoot, and maritime policies, including hull, collision, and protection and indemnity coverage.
The International Association for Continuing Education and Training has authorized EUCI to offer 0.2 CEUs for this program. For more information on the seminar, including how to attend, click here.
