Brother Enforces P-Touch® Tape Cassette Patents Against Aster Graphics, Inc.

BRIDGEWATER, N.J., Oct. 24, 2013 /PRNewswire/ -- On September 16, 2013 the United States District Court for the District of Delaware entered a Stipulation, Consent Judgment and Permanent Injunction in the case of Brother Industries, Ltd. v. Aster Graphics, Inc., et al., Case No. 1:13 cv 00323 GMS. In the Complaint, Brother Industries accused the defendants of infringing three United States patents covering its tape cassettes for its P-Touch label printers. Under the terms of the Permanent Injunction:

Aster Graphics, Inc. and its subsidiaries, affiliates, officers, directors, agents, servants, employees, successors and assigns and all other persons and organizations in active concert or participation with it, are hereby permanently enjoined and restrained from engaging in any of the following activities:

(a) Making, using, selling or offering for sale in the United States or importing into the United States, (1) any of the Accused Products and (2) any other label cassettes that infringe one or more claims of the '796, '539, '542, '389 and '127 patents;

(b) Otherwise directly infringing, contributory infringing, or inducing infringement of any of the claims of the '796, '539, '542, '389 and '127 patents with respect to (1) the Accused Products and (2) any other label cassettes that fall within the scope of one or more of the claims of either the '796, '539, '542, '389 and '127 patents; and

(c) Assisting, aiding, or abetting any other person or business entity in engaging in or performing any of the activities referred to in subparagraphs (a) and (b) above.

Aster Graphics, Inc., et al. is one of several lawsuits that Brother Industries has brought against alleged infringers of its patents covering its tape cassettes.
