Brother Enforces P-Touch® Tape Cassette Patents

BRIDGEWATER, N.J., July 24, 2013 /PRNewswire/ -- On May 7, 2013 the United States District Court for the District of Delaware entered a Stipulation, Consent Judgment and Permanent Injunction in the cases of Brother Industries, Ltd. v. Sophia Global LLC, et al., Case No. 1:13 cv 00347 GMS, and Brother Industries, Ltd. v. Chi Kin Wong, Case No. 1:13 cv 00360 GMS. In the Complaint Brother Industries accused the defendants of infringing three United States patents covering its tape cassettes for its P-Touch label printers. Under the terms of the Permanent Injunction:

Sophia Global LLC, et al. and its subsidiaries, affiliates, officers, directors, agents, past and present members, servants, employees, successors and assigns and all other persons and organizations in active concert or participation with him and Chi Kin Wong, his employees, and all other persons and organizations in active concert or participation with him are hereby permanently enjoined and restrained from engaging in any of the following activities:

(a)     Making, using, selling or offering for sale in the United Sates or importing into the United States any of the Accused Products and any other label cassettes that fall within the scope of one or more claims of the '796, '539 and '542 patents;

(b)     Otherwise directly infringing, contributory infringing, or inducing infringement of any of the claims of the '796, '539 and '542 patents with respect to the Accused Products and any other substantially the same label cassettes that fall within the scope of one or more of the claims of either the '796, '539 and '542 patents; and

(c)     Assisting, aiding, or abetting any other person or business entity in engaging in or performing any of the activities referred to in subparagraphs (a) and (b) above.

Sophia Global LLC, et al. is one of three separate lawsuits that Brother Industries has brought against alleged infringers of its patents covering its tape cassettes.

The accused cassettes were supplied to Sophia Global LLC by Jingwei Industrial Holding Limited.

CW Media Pro is an internet retailer. The lawsuit against Mr. Wong doing business as CW Media Pro is one of three separate lawsuits that Brother Industries has brought against alleged infringers of its patents covering its tape cassettes.

The accused cassettes were supplied to Mr. Wong by Kingroad Technology and AIMO Graphics CO., LTD.
