PHILADELPHIA, Aug. 3, 2017 /PRNewswire/ -- Berger & Montague, P.C., a national plaintiffs' law firm with a focus on complex, mass tort and class action litigation, has begun a defective product investigation regarding TJI Joists with Flak Jacket Protection manufactured by the Weyerhaeuser Company. The TJI Joists with Flak Jacket Protection were manufactured by Weyerhaeuser using formaldehyde, a dangerous chemical that has the potential to "off-gas" and invade consumers' homes with a smelly odor. This may cause homeowners and visitors to suffer from headaches, stinging and tearing eyes, dizziness, nausea, coughing and wheezing, and asthma-type symptoms. Formaldehyde is a known carcinogen, meaning it contributes to causing cancer in humans.
Berger & Montague, P.C. has assembled a large team of lawyers, investigators and experts, who are working hard to investigate this matter and provide counsel and representation to numerous individuals across the United States who purchased or who are scheduled to purchase a home constructed using Weyerhaeuser TJI Joists with Flak Jacket Protection that were manufactured after December 2016. These defective TJI Joists with Flak Jacket Protection were used in new housing developments and other new home construction by major builders in New Jersey, Colorado, Delaware, Missouri, Arkansas, Ohio, and other states.
Consumers report that the formaldehyde problems caused by TJI Joists with Flak Jacket Protection can cause a pickle-like odor. The formaldehyde gas can build up quickly, particularly in basements, and then emanate to other parts of the house. Homeowners are being advised not to enter their basements or to only remain in the basement for very brief periods not exceeding five minutes. Others are being advised to leave their homes altogether because of the serious safety risk caused by the escaping formaldehyde fumes.
"The last thing buying a new home should do is make you and your family sick," said Berger & Montague, P.C. Managing Shareholder, Shanon J. Carson, who leads the Firm's Consumer Protection Group. "I and my firm have handled many dangerous product liability cases but this may be the worst we have seen in the home construction context, and we are deeply committed to ensuring that our clients receive justice. Putting a dangerous product in peoples' new homes that is leaking formaldehyde is inexcusable. This never should have happened and all affected consumers need to be fully compensated and made whole."
In a successful lawsuit, consumers who purchased Weyerhaeuser's TJI Joists with Flak Jacket Protection may be able to get their money back, have their homes fully and properly remediated under the guidance of independent experts, and recover additional damages that may include long-term losses resulting from diminished home values and loss of time. In some states, consumers may be entitled to additional statutory damages. Even if the TJI Joists with Flak Jacket Protection are ultimately removed, these homes may be worth less over time due to the presence of formaldehyde at the time of the initial construction.
