Originally published in 1973 as two volumes, "McCarthy on Trademarks and Unfair Competition" now spans seven volumes and has been cited and relied upon as authority in more than 4,000 judicial opinions, including 10 from the U.S. Supreme Court. The publication explains trademark law with clear, concise analysis of cases and statutes, and offers how-to guidance for registering trademarks, examination of defenses and analysis of international aspects of trademark law. Topics covered by the more than 30 chapters include secondary meaning, likelihood of confusion and territorial extent of trademark rights, as well as literary, artistic and entertainment rights.

The institute is named in his honor and he taught at USF for 36 years.
