Attorneys for Thomas Kithier file preliminary injunction to get him back on the court

DETROIT, Jan. 3, 2018 /PRNewswire/ -- Attorneys Ven Johnson and Steve Fishman filed an emergency motion for a preliminary injunction Tuesday night, seeking to reinstate basketball star Thomas Kithier. In their motion, Johnson and Fishman argue that if forced to wait for the lawsuit to play out Kithier is left with "no adequate remedy…," as he is currently ineligible for the entire season. His attorneys want him back on the Clarkston High School basketball team by Janaury 15^th.

The Michigan High School Athletic Association (MHSAA) ruled Kithier ineligible for the 2018 season after he moved his residence from Macomb to Clarkston and enrolled at Clarkston High School. Dakota objected to allowing him to play basketball at Clarkston, alleging his move was athletically-motivated.

Last Friday Attorneys for Kithier filed a lawsuit in federal court against the MHSAA, officials at Dakota High School and others. Attorney Ven Johnson stated, "A ridiculous and unnecessary situation has been created by the MHSAA. Thomas should be on the court – period. Mr. Fishman and I plan to do whatever it takes to make sure he gets there."
