PHOENIX, Sept. 9, 2015 /PRNewswire/ -- The number of claims filed against the makers of the hypertension medication Benicar (olmesartan medoxomil) have increased dramatically since the establishment of the multidistrict litigation (MDL). All current and future lawsuits, alleging similar instances of chronic diarrhea, weight loss and other symptoms of sprue-like enteropathy while taking Benicar, are being filed in the MDL before U.S. District Judge Robert Kugler in the District of New Jersey.
Aboutlawsuits.com's Austin Kirk reported Tuesday that there are currently 1,034 cases pending against Benicar makers Daiichi Sankyo and Forest Laboratories, which is 1,000 more cases than in April 2015 when the MDL was established. The September status report also states that parties should have their proposals submitted by the end of the month for the first bellwether trials in the MDL. In mass tort litigation, all parties involved (judge, plaintiff's attorneys and defense attorneys) rely on jury rulings in bellwether trials to help them understand how the rest of the often hundreds of cases will be settled.
The FDA issued a drug safety communication in July 2013 regarding the link between abdominal pain and Benicar. According to the report, the federal agency claims, "The enteropathy may develop months to years after starting olmesartan, and sometimes requires hospitalization," and that patients, citing no other cause for the symptoms, should stop using the drug.
The FDA also states that, "discontinuation of olmesartan (Benicar) has resulted in clinical improvements of sprue-like enteropathy symptoms in all patients."
