WHAT WAS "GOOD ENOUGH" BEFORE GDPR FOR ANALYTICS & AI IS NOW ILLEGAL
Prior to the GDPR, it was "good enough" to provide course-grain privacy controls when processing analytics and artificial intelligence ('AI'). However, the May 2018 European Data Protection Supervisor ('EDPS') Opinion 5/2018 and the recently updated UK Information Commissioner's Office ('ICO') GDPR report both clarify that the GDPR now requires a specific new form of technically enforced privacy called Data Protection by Design and by Default. Data Protection by Design and by Default, as newly defined under the GDPR, requires fine-grain privacy controls over who has access to, and use of, personal data so that only the data that is necessary at a given time, for a given purpose, for a given user, is revealed. In addition, the April 2018 Article 29 Working Party Guidelines on Consent (WP259rev.01) clarifies that continued possession and/or processing of personal data for analytics & AI based on broad-based consent – which is now illegal under the GDPR – exposes data controllers and data processors to liabilities under the GDPR. The Guidelines on Consent clarifies that data controllers are permitted to transform and use historical data, as well as process new personal data, for GDPR compliant analytics & AI if the requirements for alternate legal bases, like Legitimate Interest, are satisfied.
GDPR REQUIRES STATE OF THE ART DATA PROTECTION
The GDPR shifts the burden of risk for misuse of personal data from individual data subjects to corporate data controllers and processors. This shift in the burden of risk includes an affirmative obligation to use the State of the Art in data protection. This is yet another reason why what was "good enough" before May 25th for analytics & AI is now illegal under the GDPR.
