BERWYN, Pa., May 17, 2017 /PRNewswire/ -- ATIXA will be offering a new due process track at the upcoming Title IX Training & Certification Courses in San Diego, on June 7th and 8th, presented by Executive Director, Brett A. Sokolow, Esq. Attendees are welcome to register for that track alone, or to join ATIXA for all four days by adding another two-day track, as well. The due process track is designated as a Level Four Investigator Certification, but it is a stand-alone training without pre-requisites, as long as one is already a seasoned administrator. This is not necessarily a course for those who are new to the field. ATIXA is placing a renewed emphasis on due process for the field, and know you will find this track to be very rewarding and engaging. Here is a quick synopsis of the course:
- Due process is under attack in the courts, federal agencies, and in the Congress. Higher education is facing a critical moment – If you're interested in raising the bar on the procedural and substantive fairness of your sexual misconduct resolution proceedings (or all disciplinary proceedings), this track is for you.
- Since 2012, over 170 federal lawsuits have been filed against colleges by students accused of sexual violence. Colleges and universities are now losing most of these cases. Courts are blurring the lines between public institution due process and private institution due process.
- To compound the emphasis on due process by courts, OCR changed the game further in November of 2016 with its decision in the Wesley College investigation. Now, Title IX protects accused students, too, with important implications for retaliation claims, counter-claims, interim suspension and more. Is Title IX now an independent source of due process, what do Title IX due process rights provide, and how should this impact our investigations?
- Due process has always been owed by public institutions, but the implications now for private colleges are significant. This course will show you how to protect your process, and manage the risk of lawsuits by enhancing the due process you afford to your community. This course offers the roadmap to exactly how colleges can enhance procedural and substantive protections to meet the demands of a new legal environment. Case studies and procedural analysis will enhance the ability of participants to see the due process deficits on their own campuses, and offer sound approaches to curing those deficits.
