AIG, Travelers Move to Dismiss U.S. Medicare Reimbursement Lawsuit, HB Reports
PHILADELPHIA, May 11 /PRNewswire/ -- American International Group Inc. and The Travelers Companies Inc. say the federal government's suit against them for reimbursement of payments made in a 2003 toxic tort settlement was filed too late and against the wrong business entities, according to Vivi Gorman, editor of HB's Medicare Secondary Payer Report.
The government sued AIG and Travelers, and others, claiming several hundred of the plaintiffs involved in the toxic tort action were Medicare beneficiaries, and that the government is entitled to a portion of money it paid those plaintiffs for medical purposes, citing the Medicare Secondary Payer Act. "The companies say they are the holding companies, not the actual insurers who made payments, and that, in any case, the government waited too long to file suit," Gorman said. (For complete details, interested parties are invited to send an email to Gorman's attention at [email protected] requesting a complimentary copy of her report.)
"We're committed to tracking this issue, which is tremendously important to our litigator and insurance company customers," said Tom Hagy, CEO of HB Litigation Conferences.
