The 2014 filing sought to overturn the state's Marriage Protection Act, a 1998 law banning the recognition of same-sex marriages from other states, and the Sanctity of Marriage Amendment, which enshrined the ban in the state constitution in 2006.
After the U.S. Supreme Court legalized same-sex marriage nationwide in June 2015, a federal judge ruled that Hard could collect the proceeds from the wrongful death lawsuit as the surviving spouse.
Thanks to the overturning of gay marriage bans throughout the nation, Fancher's records have been posthumously amended to show Paul Hard as his spouse. In a landmark court battle for Alabama, Hard was able to collect over $100,000 he was originally entitled to.
