NEW YORK, Dec. 11, 2013 /PRNewswire/ -- A Wright Profemur hip replacement lawsuit (http://www.consumerinjurylawyers.com/wright-profemur-hip-replacement) scheduled to go to trial last month in Georgia federal court has been settled for an undisclosed amount, Bernstein Liebhard LLP reports. According to court documents, a Settlement Order was entered in the case on November 7th in U.S. District Court, Middle District of Georgia, and the trial was taken off the Court's schedule. The Wright hip lawsuit had been filed on behalf of a plaintiff who received a Profemur hip in September 2009 but was forced to undergo revision surgery less than two years later when the femoral neck fractured. The complaint also alleged that a prototype extraction tool manufactured by Wright Medical Technology was defective and exacerbated the plaintiff's complications. (Courson, et ux. v. Wright Hip Lawsuits
Court documents indicate that this is the second Wright hip lawsuit involving the Profemur system to have settled in the past year. In March, a Joint Notice of Settlement was filed in another case pending in U.S. District Court, Northern District of California. The amount of that settlement was not disclosed. (Tucker, et ux. v. The Wright Profemur hip replacement system was approved by the U.S. Food and Drug Administration (FDA) via the 510(k) clearance program, which does not require a device to undergo human clinical trials if the manufacturer can show that its design is substantially equivalent to another product already approved by the agency. In 2009, data from the Australian National Joint Replacement Registry revealed that 11.2 percent of Wright Profemur femoral stems failed within just three years of implantation.
In a filing made with the U.S. Securities and Exchange Commission (SEC) in April, Wright disclosed that it had been named a defendant in a number of product liability claims involving Wright Profemur hip replacements. The company also warned investors that the July 2012 Stryker hip recall for Rejuvenate and ABG II hip stems had led to increased scrutiny of cobalt chrome modular neck products, something which could negatively impact Profemur sales.
Court documents indicate that Wright Medical Technology is also facing nearly 80 lawsuits involving its Conserve hip replacement line. These claims have been consolidated in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Georgia. All of these lawsuits allege injuries due to the metal-on-metal design of the Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System.
Wright's filing with the SEC also disclosed that additional Conserve hip replacement lawsuits have been consolidated in California Superior Court for pretrial handling pursuant to procedures of California State Judicial Counsel Coordinated Proceedings.
