Transvaginal Mesh Lawsuit News: Johnson & Johnson's Ethicon Unit Faces Uphill Battle In New Jersey Trial, Says Legal-Bay LLC
- Expert testifies that J&J ignored his warning about potential problems with Pelvic Mesh, just as Legal-Bay projects total claims in all mesh cases to eventually reach 100K Mesh Lawsuits.
ATLANTIC CITY, N.J., Feb. 12, 2013 /PRNewswire/ -- Legal-Bay, The Lawsuit Settlement Funding Company, which has been a public advocate for women victims of various vaginal and pelvic mesh implants, reported today that industry insiders close to the Ethicon Prolift mesh trial have advised them that the plaintiff's case has raised serious concerns as to what J&J knew about the dangers of their mesh products.
In testimony in early February, Dr. Klinge – who is a world renowned expert in mesh products- advised J&J that he believed their mesh products did not have the correct design in order to ensure safety of the patients. Ethicon did not heed the warnings of Dr. Klinge and began marketing the potentially dangerous mesh in late 2005. This has led to serious complications in thousands of women and already 1800 lawsuits in N.J. Supreme Court alone.
"Our experts close to the trial feel that the plaintiff's case is proceeding very well based on the knowledge that J&J potentially knew the dangers of this product – and still marketed it," said Chris Janish, CEO of Legal-Bay. "If the jury believes that J&J potentially put women in 'harm's way' knowingly, then there is no telling how high a jury award could be."
In a similar case against C.R. Bard in Bakersfield, CA, a California jury awarded a husband and wife $5.5MM for their Mesh related problems.
With all the news of large trials and jury awards in the media, Legal-Bay now projects potentially 100K cases to be signed up by lawyers against the 4 major transvaginal mesh manufacturers: J&J Ethicon, Boston Scientific, C.R. Bard, and American Medical Systems AMS. This could lead the total Transvaginal Mesh Litigation to top $20Bil. and go on for many years to come.
"We continue to see new clients needing both lawsuit funding and surgical funding for corrective and revision surgeries for women who do not have health insurance," said Patty Kirby, Head of Client Relations at Legal-Bay. "We have also been taking a lot of calls from women who are just starting to realize the problems of their mesh and need legal advice, and we have been advising them that it is not too late to file a claim, but the time to file a valid lawsuit is ticking." "At this point, we don't see any end to this litigation in the near future", added Ms. Kirby.
Legal-Bay and its financial partners have been committed to assisting victims of the Transvaginal Mesh lawsuit from the very beginning of the litigation for whatever services that they may need.
