MONTEREY PARK, Calif., Feb. 3, 2015 /PRNewswire/ -- On October 17, 2014, the Department of Social Services ("DSS") initiated legal action (called an Accusation) to revoke the license of Southcliff Consultants dba Southcliff Villa Manor for failing to report bodily injuries sustained by a 76-year-old Judith Dumas who resided at the facility from March 21, 2014 – March 31, 2014 to the resident's physician, the facility administrator, or seek medical attention for her.
DSS is further requesting that the licenses of the Administrator, Lino Neri, and the two involved caregivers, Rosalinda Pe and Posma Rohani, (collectively referred to as "Respondents") also be revoked. The Accusation alleges that the Respondents "engaged in conduct that is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility."
The DSS Community Care Licensing Division licenses Residential Care Facilities for the Elderly (RCFE), like Southcliff Villa Manor, that are also known as assisted living facilities. DSS is responsible for the inspection of these facilities to ensure that the RCFE's are in compliance with Title 22 California Code of Regulations.
Ms. Dumas suffered from mental retardation, and was admitted into Southcliff Villa Manor on March 21, 2014 for respite care. She was a very active woman, who loved to walk, and was able to feed herself. On March 28, 2014, it was observed by all the caregivers at Southcliff Villa Manor that she was now unable to walk or feed herself. Ms. Dumas remained in this condition for three days but the caregivers and the Administrator did not notify her physician or conservator, or seek any medical attention for her.
After Ms. Dumas' conservator picked her up on March 31, 2014 and took her to the hospital, it was discovered that she had sustained ten rib fractures on her right side, was significantly dehydrated, and a severe urinary tract infection that infected her kidneys.
Michael Moran, the managing attorney at Moran Law, located in Santa Ana, who represents Ms. Dumas in the civil action against Southcliff Villa Manor for Elder Abuse Neglect (Dumas v. Southcliff Villa Manor, et al., Case No. BC545130), states, "I am glad to see DSS step up to the plate and move forward for the residents and citizens of California. When there is severe bad conduct there must be severe consequences."
