Securus Corrects More Inaccuracies in Global Tel*Link's (GTL) Press Release

GTL Allegation #1:

"GTL…today announced that it had countersued Securus Technologies in Dallas, TX, federal court for infringing three GTL patents covering wireless services, voice messaging, and biometric capabilities."

Securus Correction #1:

This is not news and it did not occur recently as GTL inferred; the countersuit was filed in early January. Securus sued GTL for infringing four of its patents in May 2016. Eight months later, GTL filed a countersuit on January 9, 2017, asserting infringement of three GTL patents, two of which had only issued within the last month or so. Securus' analysis indicated that we are not infringing any of the patents in this suit.

GTL Allegation #2:

"In the countersuit just filed, GTL asserted U.S. Patent Nos….8,515,031"  

Securus Correction #2:

Again, no countersuit was just filed; it was filed in early January. Patent No. 8,515,031 was issued in 2013. The fact that GTL had not asserted this patent in any of the prior lawsuits shows that it knows Securus does not infringe this patent, nor the other 2 patents GTL asserted in the January countersuit.  Securus is confident that the court will agree. In addition Securus has filed a petition at the Patent Trial and Appeal Board ("PTAB") to have the claims of this GTL patent held to be unpatentable, a fact that GTL conveniently omits.  

GTL Allegation #3:

"GTL previously filed complaints in Texas federal court against Securus alleging infringement of four other GTL patents — U.S. Patent Nos. 7,783,021; 7,853,243; 7,551,732 and 7,256,816….Securus attempted to invalidate each of these four patents at the Patent Trial and Appeal Board (PTAB) during the past two years, but failed to do so."

Securus Correction #3:

GTL makes the incredible claim that Securus failed to have GTL Patent No. 7,551,732 held unpatentable by the PTAB. In fact, Securus won on all counts. The PTAB reviewed 25 (out of 27) claims of that patent and held every one of them unpatentable, handing a victory to Securus and a defeat to GTL.

GTL misleadingly fails to state that the IPR decision on GTL Patent No.  7,853,243 is on appeal before the Federal Circuit Court. 

GTL also omits to mention that Securus has filed another petition at the PTAB to have the claims of GTL Patent No. 7,783,021 held unpatentable.  Securus is confident that the PTAB will find the claims of this GTL patent unpatentable.   

GTL Allegation #4:

"We are only months away from being back in court to finally show a jury how Securus infringes these four patents, all of which have survived PTAB challenges," Oliver said.

Securus Correction #4:

GTL made the same false claim in June 2016. It wasn't true then and it isn't true now. Nothing is months away from being back in Court before a jury. GTL's counterclaim, filed solely in retaliation to Securus' claim for patent infringement will not be tried until September 2018 – certainly not "only months away". Securus' analysis indicated that we are not infringing any of GTL's patents.
