Project Lifesaver International Countersues EmFinders for Fraud, Defamation & Breach of Contract After EmSeeQ Tracking Device Fails Independent Testing
Project Lifesaver Remains Firm on Its Nationwide Duty to Select and Provide the Best Technical Equipment for Tracking Impaired Individuals to Over 1,100 Member Agencies Across the U.S.
CHESAPEAKE, Va., Nov. 29, 2010 /PRNewswire-USNewswire/ -- Project Lifesaver International responded today to allegations of breach of contract and tortious interference brought by EmFinders, countersuing for fraud, defamation and breach of contract after their cellular tracking device failed independent testing in multiple geographic areas.
Established in 1999, Project Lifesaver trains member agencies on search-and-rescue techniques and technologies that help families quickly find loved ones who wander as a result of Alzheimer's, Down syndrome, dementia, autism, and other cognitive conditions. In an effort to bring those individuals home safely, Project Lifesaver is tasked with evaluating the effectiveness of current equipment in the field and keeping members apprised with accurate information. That commitment has allowed Project Lifesaver to save 2,250 lives to date.
On June 8, 2010, Project Lifesaver entered into an agreement to help EmFinders introduce their cellular tracking technology—the EmSeeQ—to Project Lifesaver's 1,100 member agencies. Under that contract, EmFinders represented that its tracking device product operates effectively and reliably with a success rate of ninety-six percent. Upon introducing the product to member agencies, Project Lifesaver found that independent testing indicated that the EmSeeQ failed to operate nearly half of the time.
Project Lifesaver recommended suggestions for product improvement, focusing specifically on training and procedures that would improve the EmSeeQ's effectiveness. Those recommendations were not heeded. In November, EmFinders brought suit against Project Lifesaver for breach of contract. Project Lifesaver countersued today for fraud, breach of contract and defamation.
