During a two-week trial, the jury heard testimony from witnesses including several doctors and Ms. Carlino herself, who was implanted with the product in 2005 to treat a condition known as stress urinary incontinence (SUI).
Carlino alleged a design defect of the Ethicon TVT product and backed it up with medical experts who testified that the device erodes into the body tissue after implanted and prevents tissue from properly growing within the body. This causes severe complications in patients including chronic pain and inability to have intercourse. Despite multiple revision surgeries to remove the product, Carlino's condition had not improved.
The jury agreed and after deliberations, awarded Ms. Carlino $3.25 million in compensatory damages for her pain and suffering, $250,000 to her husband for loss of consortium and $10 million in punitive damages.
