Legal-Bay Reports Settlement in Medical Malpractice Lawsuit Over Joan Rivers' Death
Lawsuitssettlementfunding.com, a Case Funding Firm, says the family of comedian Joan Rivers, who died after she underwent a routine endoscopy in a clinic in NYC, has settled the medical malpractice lawsuit against the facility.
LOS ANGELES, May 16, 2016 /PRNewswire/ -- Legal-Bay LLC, The Lawsuit Settlement Funding Company which operates lawsuitssettlementfunding.com, reported today that Joan Rivers' family has settled the medical malpractice lawsuit over Rivers' death.
Joan Rivers, a comedian, and star of the show "Fashion Police" on E!, was 81 years old when she died days after she underwent a routine endoscopy at a clinic in NYC. According to ABC News, Rivers had gone to Yorkville Endoscopy on the Upper West Side in Manhattan for a routine procedure and stopped breathing. Melissa Rivers, her daughter, filed the medical malpractice lawsuit in 2015 in Manhattan, alleging that "doctors performed unauthorized medical procedures, snapped a selfie with the comedian and failed to act as her vital signs deteriorated."
According to ABC News, "The lawsuit had alleged that doctors at the clinic mishandled Rivers' endoscopy and performed another procedure, known as a laryngoscopy, on Rivers' vocal cords without consent. The suit claimed that an anesthesiologist expressed concern over what the procedure would do to Rivers' ability to breathe, but was told she was being 'paranoid' by the gastroenterologist performing the endoscopy."
The city's medical examiner found that Joan Rivers had died of brain damage as a result of a lack of oxygen after she stopped breathing during the procedure, and her death was classified as a "therapeutic complication."
Both the clinic and Rivers' family recently agreed to settle the case to avoid litigation. The amount of the settlement has not been disclosed.
