PHILADELPHIA, Nov. 13, 2014 /PRNewswire/ -- Legal-Bay LLC, The Lawsuit Settlement Funding Company, reported today that the NFL concussion suit settlement for about $765 million is expected to be officially approved as most players seem to be accepting the deal. A whopping 99% of those who were offered the settlement are on board with it. According to court filings, settlement notices were sent to over 25k players and nearly 9k relatives of deceased players, and over 99% of those involved are in support or acceptance of the settlement. According to court documents, the number of those who have opted out is less than 1% of those covered by the deal. In that 1% are approximately 200 former players or their families. Those who have opted out have the option to sue the NFL individually, but they would have to prove that their brain injuries were a result of concussions during league play.

The landmark settlement is still waiting final approval, and U.S. District Judge Anita Brody has scheduled a fairness hearing, which will be held November 19th in Philadelphia. Also, according to ESPN, a federal judge will be taking written objections through December 11th. According to USA Today, "The settlement would provide awards of up to $5 million for ALS (Lou Gehrig's Disease), $3.5 million for Parkinson's and Alzheimer's and $3 million for neurocognitive impairment such as dementia." Other less severe traumatic brain injuries, including CTE, will receive awards ranging up to $1MM to $2MM. However, the older the retiree the lower the award will likely be.
Patty Kirby, Head of NFL Funding at Legal-Bay, commented on the company's focus to assist NFL players get some cash relief today, "We are surprised at the rate of Opt-in's on this particular litigation, especially with so much opposition initially. However, the lawyers seemed to achieve the best deal for all involved to get paid as quickly and fairly as possible without contesting liability. Unfortunately the approval of the deal on Nov. 19th may just be the start of the payment process, as the NFL has provisions to appeal the awards and no one knows the timing of this of yet. Our guess is that most claims will not see payment until late 2015 or later. However, our firm stands committed to helping NFL players and their families get some cash to pay bills immediately if they cannot wait for their full payment in 2015."
