According to the National Bankruptcy Research Center (NBKRC), February 2011 bankruptcy filings continued a downward trend as filings were slightly above 100,000, nominally up 11% from January 2011. But filings in January usually are the lowest of the year, so the jump, on a seasonally adjusted basis (accounting for the normal variation in filings through the course of the last four years), amounts to an increase of only 1%. More notably, filings were down 8% from last February; filings to date in 2011 are down 9% from the same time last year.
"Our numbers show a similar trend, although bankruptcy levels in both California and Florida remain high and currently represent 25% of the clients we serve," said Beth Mason, InCharge's Director of Outreach Programs for Bankruptcy Services. "The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, or BAPCPA, requires debtors to complete both Pre-Filing Credit Counseling and Pre-Discharge Debtor Education courses, of which InCharge provided 330,000 during 2010 alone."
