Hilliard Munoz Gonzales LLP: GM Withdraws Motion After DOJ Notified Of Violation
CORPUS CHRISTI, Texas, Oct. 7, 2015 /PRNewswire/ -- Monday, Bob Hilliard, appointed by the Federal Judge in the GM MDL litigation to be the lead attorney for all personal injury and death cases caused by GM's defective ignition switch, sent a letter to Preet Bharara, the United States Attorney for the Southern District of New York who recently finished his criminal investigation of GM's ignition switch debacle.
Hilliard's letter addressed a recent motion filed by GM in the civil litigation, (MDL) seeking to dismiss an ignition switch case and requesting sanctions. Hilliard pointed out that the motion was in violation of GM's Deferred Prosecution Agreement with the US Government.
GM immediately withdrew its Motion.
Hilliard states, "The ink is barely dry on the deal with the Department of Justice and GM was already ignoring the direct promises it made, and the terms it agreed to abide by. It took me sending a letter to the US attorney to have GM behave and abide by the terms it agreed to in its Deferred Prosecution Agreement."
"Every lawyer in the country who has an ignition switch case against GM needs to understand exactly what GM promised the US Government so as to avoid prosecution, and not let GM get away with violating the terms of the deal in order to gain an advantage in civil litigation."
"GM needs to understand this is not a game. People died. Children were killed in these defective vehicles. You can't cut a deal with the government, promise to behave, and then immediately go into civil litigation and intentionally break your word."
"By all accounts GM cut a very good deal with the DOJ. My hope is that GM now appreciates that, on behalf of the victims, we are watching and expecting them to live up to their agreement and not thumb its nose at the very terms it agreed to."
"There needs to be accountability. GM's General Counsel signed off on this deal. He is in charge of all of his lawyers. Those lawyers know better than this. This should not be rocket science for GM, when defending the hundreds of civil cases around the county GM must abide by the clear terms and factual concessions it agreed to in the Deferred Prosecution Agreement."
"I'm hoping this is not the second verse to the same old GM song."
"GM is not allowed, through either its lawyers or its witnesses, to take a position 'in any litigation' contrary to what it agreed was the full truth of the ignition switch defect tragedy."
"GM cut a deal to avoid prosecution and avoid being indicted. As part of that deal GM stipulated and agreed to the truth of certain facts and also promised not to take a position in any litigation that contradicts those facts. Yet, less than 2 weeks after it entered into this Deferred Prosecution Agreement, it did just that. This shows it still has a continuing attitude of remarkable arrogance and entitlement."
