The judge ruled against the bid because the jurors on the case carefully considered evidence which suggested Takeda Pharmaceuticals and Eli Lilly knew the use of Actos over an extended period of time could lead to an increased risk in developing bladder cancer but neglected to adequately warn doctors and patients of the possibility. The verdict is the second largest in the U.S. in 2014, according to data compiled by Bloomberg, and is likely to be reduced on appeal because of its sheer size, according to legal experts. Court documents show that the case at hand was the first to go to trial of over 3,000 Actos lawsuits pending in the Western District of Louisiana. All of the pending claims in Louisiana allege that Takeda as well as the other defendants hid the risk of bladder cancer associated with the extended use of the drug.
