Actos Lawsuit Settlement Funding Amounts Increased at Legal-Bay Funding
Case Funding Firm adds to funding amounts as Bellwether trials kick into high gear after $9Bil verdict is failed to be dismissed on Takeda post-trial motion.
HOUSTON, Sept. 25, 2014 /PRNewswire/ -- Legal-Bay LLC, The Lawsuit Settlement Funding Company, announced today that they have increased their funding amounts on Actos cases as the litigation picks up steam as more bellwether trials are expected in 2015. On August 28th, according to Business Week and Bloomberg News, Takeda Pharmaceutical Co. and Eli Lilly & Co. lost a bid to have U.S. District Judge Rebecca Doherty (the judge overseeing thousands of Actos lawsuits) throw out a combined $9 billion punitive-damage award over allegations the drug makers hid the risks of cancer due to the Actos diabetes medicine. The judge ruled against the bid because the jurors on the case carefully considered evidence which suggested Takeda Pharmaceuticals and Eli Lilly knew the use of Actos over an extended period of time could lead to an increased risk in developing bladder cancer but neglected to adequately warn doctors and patients of the possibility. The verdict is the second largest in the U.S. in 2014, according to data compiled by Bloomberg, and is likely to be reduced on appeal because of its sheer size, according to legal experts. Court documents show that the case at hand was the first to go to trial of over 3,000 Actos lawsuits pending in the Western District of Louisiana. All of the pending claims in Louisiana allege that Takeda as well as the other defendants hid the risk of bladder cancer associated with the extended use of the drug.

Patty Kirby, Head of Client Relations, commented on the firm's increased commitment, "We continue to monitor the Actos lawsuit settlement news and believe the judge failing to throw the large $9bil verdict is a good sign for the plaintiffs suffering from Actos bladder cancer. Unfortunately, the bellwether trials are expected to last well into 2015 and this could delay a potential global settlement for the over 3,000 active Actos cases for a long time. Legal-Bay is now willing to assist plaintiffs with even larger pre-settlement amounts if they so desire."

As of 2014, approximately 4,000 active Actos lawsuits have been filed in both State and Federal Courts throughout the U.S., including California, Illinois, Louisiana, and Nevada. Some Actos lawsuits have gone to trial and resulted in one large award for the plaintiff's side that has survived post-trial motions. In past Actos trial verdicts, the plaintiffs have been successful only to have the verdicts thrown out in favor of Takeda. Legal experts still anticipate that patients who have contracted bladder cancer, without any other risk factors, such as smoking, could have average case settlement values north of $250K if an Actos global settlement is reached for the majority of the estimated 3k active cases.
