ATLANTA, Dec. 8, 2015 /PRNewswire/ -- Legal-Bay LLC, The Lawsuit Settlement Funding Company, announced today that an $11 million verdict was reached against Wright Medical Technology Inc. over their Wright Conserve metal hip implant in the first federal bellwether trial over the device. The large verdict resulted in $10 million in punitive damages and $1 million in compensatory damages. According to court records, the case lasted two weeks, and took place in the U.S. District Court in the Northern District of Georgia. The woman plaintiff involved was implanted with the metal-on-metal Conserve hip implant in 2006, and then was later diagnosed with "a loosened and displaced acetabular cup" and had to undergo surgery in 2012 where the surgeon found signs of metallosis – metal poisoning in the body – which in turn caused soft tissue damage. The lawsuit alleged that the device was defectively designed, and the manufacturer failed to warn people of the risks.

There are still more than 500 lawsuits pending against Wright Medical Technology Inc. in the federal multidistrict litigation (MDL 2329). The other cases are similar to the case at hand, where the plaintiffs involved were implanted with the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, or the Conserve Resurfacing System, and experienced complications. The complications and injuries include the following: metallosis, pain, swelling, tissue damage, and other injuries, as well as revision surgery. Wright Medical Technology Inc. also faces lawsuits over their Profemur hip implant; and in their first trial over that device, jurors in California were in favor of the plaintiff, and a $4.5 million verdict was reached against Wright Medical Technology.
Patty Kirby, COO and Head of Client Relations, commented on the recent verdict against Wright Medical Technology, "The large jury award is just another win for plaintiffs who have suffered issues from metal-on-metal hips. We have been very active in following all of these litigations, including the DePuy, Stryker, and Biomet hip cases. Some of these litigations have been initiated due to recalls, but to date, the Wright Hip is not one of them, and the company continues to deny liability. In these situations, similar to the J&J Pinnacle litigation, the potential for settlements takes many years."
