Steckler LLP Secures Victory for Defense in Dietary Supplement Lawsuit

DALLAS, Jan. 28, 2016 /PRNewswire/ -- In a landmark victory for the Dallas-based dietary supplement company USPlabs, LLC, a federal judge in El Paso signed a court order dismissing with prejudice all claims against all defendants in Sparling vs. USPlabs et al, Case No. 3:13-cv-00323 (W.D. Texas).
The highly publicized lawsuit alleged that USPlabs, LLC's product, Jack3d, contributed to the death of a soldier during a military training exercise at Ft. Bliss, Texas, in 2011. USPlabs has steadfastly maintained that its products are safe. Now, a court has ruled that the scientific evidence presented by plaintiffs was unreliable as a matter of law and disqualified plaintiffs' expert witnesses from testifying. Citing a report by the United States Department of Defense in the Order Overruling Plaintiff's Objections, the court held that the "evidence does not establish that DMAA containing products are causally associated with adverse events."
