Purchasers of Kashi or Bear Naked Food Products--in California--may be affected by class actions lawsuits, announces Feinstein Doyle Payne & Kravec LLC
LOS ANGELES, Nov. 6, 2013 /PRNewswire/ -- Feinstein Doyle Payne & Kravec LLC announces that two class actions have been certified by the United States District Court for the Southern District of California.
The Kashi lawsuit claims Kashi misbranded certain food products by labeling those products (i) "Nothing Artificial" when they should not have been labeled in that manner because they contained one or more of the ingredients Pyridoxine Hydrochloride, Alpha-Tocopherol Acetate and/or Hexane-Processed Soy ingredients (the "Nothing Artificial Products"); or (ii) "All Natural" when they should not have been labeled in that manner because they contained one or more of the ingredients Pyridoxine Hydrochloride, Calcium Pantothenate and/or Hexane-Processed Soy ingredients (the "All Natural Products").
The Court certified the following Classes:
California "Nothing Artificial" Class: All California residents who purchased Kashi Company's food products on or after August 24, 2007 in the State of California that were labeled "Nothing Artificial" but which contained one or more of the following ingredients: Pyridoxine Hydrochloride, Alpha-Tocopherol Acetate and/or Hexane-Processed Soy ingredients. The Court excludes from the class anyone with a conflict of interest in this matter.
California "All Natural" Class: All California residents who purchased Kashi Company's food products on or after August 24, 2007 in the State of California that were labeled "All Natural" but which contained one or more of the following ingredients: Pyridoxine Hydrochloride, Calcium Pantothenate and/or Hexane-Processed Soy ingredients.
Purchasers who bought the Nothing Artificial Products or the All Natural Products for resale are not included as is anyone with a conflict of interest in this matter.
The Bear Naked lawsuit claims that Bear Naked misbranded certain food products by labeling those products "100% Pure & Natural" or "100% Natural" when they should not have been labeled in that manner because they contained Hexane-Processed Soy ingredients (the "100% Pure & Natural or 100% Natural Products").
The Court certified the following Class:
All California residents who purchased Bear Naked, Inc.'s food products on or after September 21, 2007 in the State of California that were labeled "100% Pure & Natural" or "100% Natural" but which contained Hexane-Processed Soy ingredients. Purchasers who bought such Products for resale are not included as is anyone with a conflict of interest in this matter.
Kashi and Bear Naked each deny that they did anything wrong and assert their labels were truthful and consistent with the law. The Court has not decided whether the plaintiffs or defendant is right in either lawsuit. A trial is set to begin in both lawsuits on February 11, 2014.
You have a choice whether to stay in the Classes or not, and you must decide this now. To stay in the Classes, you do not have to do anything. If money or benefits are obtained notice will be publicized about how members of the Classes can ask for a share of the money. You will be legally bound by all orders and judgments of the Court, and you won't be able to sue, or continue to sue about the legal claims in that case. If you exclude yourself from the Classes, you cannot get any of the money or benefits from that lawsuit if any are awarded, but you will keep any rights to sue about these claims and will not be bound by any orders or judgments in that case.
To exclude yourself from the Kashi lawsuit, send a letter to Astiana Claims Administrator, PO Box 43034, Providence, RI 02940-3034, postmarked by January 27, 2014, that says you want to be excluded from Astiana, et al. v. Kashi Company. Include your name, address and telephone number.
To exclude yourself from the Bear Naked lawsuit, send a letter to Thurston Claims Administrator, PO Box 43034, Providence, RI 02940-3034, postmarked by January 27, 2014, that says you want to be excluded from Thurston, et al. v. Bear Naked, Inc. Include your name, address and telephone number.
