NEW YORK, Oct. 19, 2016 /PRNewswire/ -- Plaintiffs who allegedly suffered serious kidney injuries, including chronic kidney disease or kidney failure, related to the use of Nexium or another proton pump inhibitor have asked a judicial panel to consolidate all such federally-filed claims before a single judge in the U.S. District Court, Middle District of Louisiana. According to a Motion for Transfer filed with the U.S. Judicial Panel for Multidistrict Litigation (JPML) on October 17th, at least 15 proton pump inhibitor lawsuits involving acute interstitial nephritis, chronic kidney disease and kidney failure are already pending in federal courts around the U.S. However, the moving plaintiffs contend that thousands of additional cases are currently under investigation, and assert that hundreds of new lawsuits will be filed in the coming months. Proton Pump Inhibitor Lawsuits

According to the October 17th Motion for Transfer, all of the proton pump inhibitor lawsuits currently pending in federal courts claim that the drugs' manufacturers failed to adequately warn consumers that use of prescription and/or over-the-counter versions could cause irreparable harm to the kidneys. Plaintiffs assert that without centralization, there exists "the possibility of inconsistent pretrial rulings exists, especially with respect to the proper scope and extent of discovery, causation, and other factual and legal issues."
The Motion points out that one of the pending proton pump inhibitor lawsuits was filed in the Middle District of Louisiana, and notes that there are currently no other multidistrict litigations underway in the jurisdiction. As such, plaintiffs contend that the District possesses the "proper resources and time necessary to manage this complex litigation." They have also proposed the District of New Jersey, the Southern District of Illinois, the District of Kansas or the Western District of Louisiana as possible alternative venues for the centralized proceeding.
