Professor Dinwoodie Explores the Development of Contemporary Trademark Law
CHICAGO, Nov. 11, 2010 /PRNewswire/ -- Graeme B. Dinwoodie, Professor of Intellectual Property and Information Technology Law at the University of Oxford, delivered the 2010 Beverly W. Pattishall Distinguished Lecture on Trademark Law, organized by The John Marshall Law School's Center for Intellectual Property Law. Beverly W. Pattishall, a pioneer in the field of trademark law, was a senior partner for many years at the Chicago intellectual property law firm and litigation boutique Pattishall, McAuliffe, Newbury, Hilliard & Geraldson LLP.
Attended by an overflow crowd of experienced trademark practitioners and law students, Professor Dinwoodie's lecture focused on the role of the U.S. Courts in developing modern trademark law through the interpretation of the text of the Federal Trademark Act, commonly known as the Lanham Act. Historically, trademark protection grew out of the common law of unfair competition. The Lanham Act codified the principles developed under the common law. As Professor Dinwoodie noted, practitioners, such as the late Beverly W. Pattishall, helped shape the courts' interpretations of the Lanham Act through scholarship and advocacy.
With the advent of the Internet and rapid globalization, trademark law gained an ever-increasing profile among the general public and within the legal community. Between 2000 and 2004, the U.S. Supreme Court heard at least one case per year interpreting the Lanham Act. Circuit court opinions interpreting the Lanham Act impact businesses throughout the world. Professor Dinwoodie highlighted the manner in which these courts have analyzed the text of the Lanham Act to arrive at our current understanding of the law.
