Patriot Scientific Announces International Trade Commission Ruling
CARLSBAD, Calif., Feb. 20, 2014 /PRNewswire/ -- Patriot Scientific Corporation (OTCBB: PTSC) today announced that the United States International Trade Commission (ITC) has issued a notice affirming the Administrative Law Judge's September 6, 2013 Initial Determination (ID) in regards to Patriot's US 5,809,336 ('336) patent. An Investigation had been undertaken by the ITC in which Patriot and other complainants alleged violations of Section 337 of the Tariff Act, seeking importation bans against multiple respondents for certain wireless consumer electronics devices marketed for sale in the United States. The ITC reaffirmed that it found no violation of Section 337 in the aforementioned investigation.
"We are disappointed the ITC has upheld its previous finding in regards to the '336 patent," stated Cliff Flowers, Patriot's Interim Chief Executive Officer. "Several of our shareholders question how our October 2013 victory against HTC in U.S. District Court for the Northern District of California over the same '336 patent, reconciles with the ITC's position. Simply stated, we believe the District Court got it right, and the ITC got it wrong. We are evaluating our options with the ITC."
Respondents who remained subject to the ITC Investigation included Barnes & Noble Inc., Garmin Ltd., HTC Corporation, Huawei Technologies Co. Ltd., LG Electronics, Nintendo Co. Ltd., Novatel Wireless Inc., Samsung Electronics Co. Ltd., and ZTE Corporation. Parallel proceedings in the U.S. District Court for the Northern District of California alleging infringement of Patriot's '749, '890 and '336 patents against the remaining ITC Respondents, excluding HTC, have been stayed pending resolution of the ITC Investigation.
In October, Patriot announced that it had won its patent infringement lawsuit against HTC Corporation in the U.S. District Court for the Northern District of California. HTC was found to infringe multiple claims of Patriot's '336 patent. The '336 patent is one of several patents that are part of a larger portfolio held by Patriot, known as the Moore Microprocessor Patent Portfolio™.
