Paparazzi Agency Defends Trademark

LOS ANGELES, Aug. 13 /PRNewswire/ -- On August 10, 2010, Buzz Foto, LLC, a California limited liability company, filed suit against NuBuzz Photo, a New York corporation, in the United States District Court, Central District of California, seeking damages and an injunction for trademark infringement and unfair competition.  

Buzz Foto is a celebrity photo agency that operates via Internet at www.buzzfoto.com.  It offers, among other services, the license and sale of photography in the entertainment industry.  Its co-founder is Brad Elterman, a world renowned photographer who has been covering the celebrity scene since the early 1970s.  NuBuzz Photo is a competing enterprise also engaged in the celebrity photo business that also operates via Internet at www.nubuzzphoto.com, offering the sale of various photographs and photography services.

Brad Elterman said of the lawsuit: "The NuBuzz company name has the potential to create massive confusion among our customers and has already done so.  Buzz Foto is my life, built around our mark which, in turn, is built around my reputation as an entertainment photographer and photo agent since the mid 1970s."  Cofounder of Buzz Foto Henry Flores remarked, "We have tried to resolve this dispute outside the court systems but it was not successful.  Thus, we are forced to file this lawsuit to protect our brand."
