LANCASTER, Pa., Feb. 5 /PRNewswire-USNewswire/ -- A Lancaster County, Pennsylvania resident, D. Gumble, has filed a federal court complaint on behalf of a Pennsylvania class against Toyota and related entities for defects in Toyota vehicles. Gumble is represented by RodaNast, P.C. and attorneys Dianne Nast and Erin Burns of that firm.
The case is brought on behalf of all Pennsylvania residents who own a Recalled Vehicle (a vehicle subject to the voluntary recalls announced by Toyota in September 2009 and January 2010). The Complaint alleges that Toyota manufactures and sells defective automobiles which can suddenly and without warning accelerate out of control.
The complaint seeks money damages from Toyota for Toyota's conduct in knowingly marketing vehicles with concealed defects.
In the last four months, Toyota has instituted at least three recalls of these automobiles, covering over 4 million cars. The first recall occurred on September 29, 2009 and Defendants claimed that the sudden unintended acceleration problem was caused by defective floor mats.
The second recall occurred in early January 2010 and expanded the first recall to include additional models within the scope of the first recall and again identifying the issue as a problem with floor mats in the automobiles.
The third recall was announced on January 21, 2010, and included a different set of automobiles, some within the scope of the first two recalls, but others not. This third recall attributed the risk of sudden unintended acceleration to the possibility that certain accelerator pedal mechanisms may, in rare instances, mechanically stick in a partially depressed position or return slowly to the idle position.
