Game Developer MumboJumbo Files New Motions in Lawsuit Against PopCap, According to Rose Walker
DALLAS, June 29, 2011 /PRNewswire/ -- Casual game developer and publisher MumboJumbo, LLC is filing new court motions in an attempt to ensure that PopCap Games, Inc. pays a multimillion-dollar judgment awarded to MumboJumbo last year, even if PopCap is sold.
Dallas-based MumboJumbo is asking Dallas County's 193rd Civil District Court to increase the amount of money Seattle-based PopCap should post in bond during the appeals process, in addition to requesting the deposition of a top-ranking PopCap executive in order to learn more about that company's rumored sale.
Recent reports suggest that PopCap may soon be acquired by Redwood City, Ca.-based Electronic Arts or San Francisco-based Zynga, among others, for as much as $1 billion.
MumboJumbo's $7.3 million fraud and breach of contract verdict against PopCap in 2010 followed trial evidence showing how PopCap interfered with MumboJumbo's relationship with a major retailer, negatively impacting MumboJumbo's own sale price. The Dallas company estimates its value was in the range of $120-$150 million at the time PopCap unlawfully interfered with its business.
Both sides have appealed the verdict and a Dallas appellate court is considering the appeals, as well as MumboJumbo's request for a new trial. The case is PopCap Games, Inc. v. MumboJumbo, LLC, No. 07-12157.
"We're hearing all sorts of talk about a sale or IPO of PopCap – and that's great – but the company has a responsibility to pay its debts," says attorney Martin Rose of Rose Walker in Dallas, who represents MumboJumbo. Depending on the terms of the reported sale, there may be no assets left in PopCap to satisfy the full judgment, including attorney fees."
MumboJumbo was one of the first companies to develop and publish casual games, and pioneered the market for casual games in the retail channel. At one point, MumboJumbo had an exclusive agreement with PopCap to publish 'Bejeweled' and certain other games, and as a result PopCap's retail revenue grew from $58,000 in 2002 to $3.8 million in 2005, based solely on MumboJumbo's sales and marketing efforts.
