Never Charged, Never Convicted Of A Crime
Although Richard Fine was never charged or convicted of a crime, Judge David Yaffe held him 18 months in solitary "coercive confinement" in L.A. County Jail for civil contempt of court. Fine had attempted to remove the Judge from the case where he had admitted taking illegal payments from the County, a party to the case. (Marina Strand Colony Homeowners II v County of L.A.)
In His Own Words
Richard Fine, told Full Disclosure, "I can sit here today and tell you that based upon every brief that was filed and based upon every Supreme Court Decision that I should never have been in jail and that every court avoided their responsibility and did not follow the law." He noted that U.S. Supreme Court precedent cases have held that individuals could not be held more than five days for civil contempt of court.
Judge Resigns From Office Early
Strangely, the controversy resulted in Judge Yaffe's early resignation from office, just days after releasing Richard Fine and one day after the Judge himself had vowed to keep Fine in jail. His release order stated: "By keeping him incarcerated for 18 months the court has deterred others from defying its orders to the extent it is possible to do so given the facts of the case."
