ROCHESTER, N.Y., Aug. 1, 2014 /PRNewswire/ -- A New York State Supreme Court judge has denied Eastman Park Micrographics' (EPM) motion for a preliminary injunction—a temporary order that had prohibited Kodak Alaris from certain competitive conduct in the U.S. and Canadian micrographics service space since July 14. The decision stated that, "The court overlooked or misapprehended the law or facts on the original motion," and that EPM failed to show proof that its cause for a preliminary injunction against Kodak Alaris had merit. The heart of Judge Matthew A. Rosenbaum's decision was that EPM failed to establish a contractual basis for restraining Kodak Alaris from competing with EPM.
"We are very pleased with the outcome of this case, which allows us to offer our services to all micrographics customers in the U.S. and Canada," said Dolores Kruchten, president, Document Imaging division, Kodak Alaris. "From the onset, we have vigorously maintained that EPM's claims are without basis, and the decision handed down by the court confirms this. It's an extremely positive result for Kodak Alaris, for our channel partners and for our customers in the U.S. and Canada."
Kodak Alaris also directly serves micrographics channel partners and customers, providing technical services and support in Europe, Asia and Latin America.
