California Jones Act Seaman Lawyer: Court Rules Jones Act Seaman Lawsuit Against Ponzi-Scheme/Internet Porn Related Company May Proceed
SAN DIEGO, Jan. 26, 2011 /PRNewswire/ -- California Jones Act Lawyers from The Turley Law Firm succeeded in a Motion For Relief From Preliminary Injunction, which allows a Jones Act Seaman Lawsuit to proceed. The case concerns Medical Capital Holdings, whom the SEC has sued for a Ponzi-type scheme whereby company officers skimmed cash from investors and directed millions of dollars into non-medical investments, including a $4.5 million party yacht, the Home Stretch, and according to the OCWeekly, an Internet porn company.
Plaintiff Hollie Sault worked aboard the luxury yacht the Home Stretch as a stewardess. She was severely injured when the vessel was in Costa Rica. The light bulbs in a stairway were burnt out and Ms. Sault fell down the stairs due to inadequate visibility. Ms. Sault sued, but the suit was shut down due to the Central District of California Court's Granting Defendant's Motion to Stay. The U.S. District Court recently granted Ms. Sault's Motion For Relief From Preliminary Injunction. The Court's Order allows Ms. Sault's Jones Act lawsuit filed in San Diego Superior Court to proceed.
According to San Diego Boating Accident Attorney, Bill Turley, "The vessel owners have been exposed as frauds by the SEC. They have been hiding behind the SEC's investigation in an effort to keep from having to provide Seaman's damages to a crew member who suffered severe injuries aboard their yacht." "The Court's Ruling is now going to allow further exposure of the bad acts of these company officers," states Mexico Maritime Lawyer Mr. Turley.
"This a recurring theme, Seaman working on million-dollar U.S. based yachts are injured in Mexico, Costa Rica and other exotic locations around the world. Once they are injured, the millionaire vessel owners refuse to follow US law and provide Seaman's benefits," adds San Diego Maritime Lawyer Turley. The lawsuit alleges that once she was injured the company lawyer tried to pressure her to sign away her rights in order to see a doctor in Cabo Mexico. "Many millionaires act as if they are above US law. The only difference here is according to the SEC, the Defendants used stolen money to buy the million dollar yacht," the Mexico Maritime Lawyer explains.
