In a like case, the USPTO recently granted Butamax's request for reexamination of Gevo patent number 8,101,808 rejecting all 156 claims of the patent. In that case, certain claims were rejected in view of prior Butamax inventions. Given that the Butamax inventions have been accorded significant priority over the Gevo applications, we anticipate a similar result for the '089 patent.
