Attorney David Perecman Appears on Stossel to Discuss Defensive Medicine
New York City medical malpractice attorney David Perecman appeared on Stossel to discuss whether fear of lawsuits causes doctors to engage in defensive medicine.
NEW YORK, May 17, 2016 /PRNewswire/ -- Last Friday, Attorney David Perecman of The Perecman Firm appeared on Fox Business' Stossel to discuss medical malpractice litigation, the role of lawyers in the healthcare industry, and the potential for unnecessary medical testing.
Perecman was met with adversity – the segment opened with host John Stossel proclaiming "I hate those lawyers" – but Perecman held the line, explaining that any injured individual has the right to be compensated.
Stossel posed the idea that, because people are scared of lawyers and being sued, lawyers are responsible for making treatment more costly, to which Perecman countered, "But the person who has been injured recovers, and they deserve to recover. Do they walk away? Do they grin and bear it? Does the person who has a brain-damaged child as a result of somebody's negligence take it on the chin? I don't think so."
The segment also covered medical testing, and whether the fear of litigation compelled doctors to conduct unnecessary tests.
"I heard this, and frankly don't believe it," said Perecman. "It's very easy to blame the lawyers. The doctors in their surveys say defensive medicine is because of the lawyers. The only problem is that the government, the congressional oversight offices, have all done their own studies – not surveys. These studies say that the AMA and the American Academy of Orthopedic Surgeons surveys were unreliable, and that the more likely cause was the income [doctors] get from doing the tests."
