Adli Law Group, P.C. Expresses Concern over a Tech-Industry Copyright Ruling
As Google fights the court ruling in favor of Oracle on a major copyright case, business litigation and patent infringement expert Dr. Dariush Adli outlines the potential effects for the tech industry
LOS ANGELES, Oct. 17, 2014 /PRNewswire/ -- Last May, the expert business litigation team at Adli Law Group, P.C. watched with great interest as tech giant Google expressed disappointment and surprise after an appeals court in Washington weighed whether Oracle can copyright application programming interfaces (APIs) for the Java programming language. In a unanimous three-judge ruling, the U.S. Court of Appeals found that, despite the fact Google had written its own code to implement software, it had infringed copyright by using tech-developer Oracle's "declare code". Now, Google is urging the Supreme Court to reverse the decision. They worry the decision could stunt the technology sector by granting monopolies on the basic building blocks of innovation – which could have long-lasting effects for the many tech-industry clients of patent lawyer in Los Angeles Dr. Dariush Adli, PhD, Esq., his team at Adli Law Group, P.C.
The Los Angeles trademark attorney – known for his work in business litigation and patent infringement cases at Adli Law Group, P.C. – is following the case with great interest, as the camp at Google says that it is disturbed by the appeals court ruling. Google asserts that it goes against most traditional understandings of the idea/expression dichotomy under copyright law. The dichotomy holds that a form or concept can't be protected, but that a specific expression of it can be. For instance, basic three-act play structure can't be copyrighted, but a specific play can be.
According to the tech blog Gigaom.com, the case hinged on a claim by Oracle that is owns 37 Java-related application protocol interfaces (APIs) that are used in Google's Android operating system. The decision could allow Oracle to seek millions from Google and thousands more from Android developers around the world. Perhaps even more damaging, it could inspire other companies to make similar API-based claims. "Programmers have invested significant time and effort in learning the Java language, including the shorthand commands," writes Google. "But now, long after Sun lured computer programmers into the Java community…Sun's successor Oracle is attempting to build a wall around use of Java's method headers," Google wrote.
No matter how persuasive Google's actions prove to be towards the Supreme Court in their case against Oracle, there is no question that this is a volatile time for inventors and other professionals looking to protect their intellectual property and ideas.
